Chapter 7 (straight liquidation) generally allows you to discharge most if not all your debts while keeping all your personal possessions. Chapter 13 (re-payment plan) can be the best option if your home is in foreclosure, but you have regular income and could keep the home if you were allowed to get current on your loan. Changes to the 2005 Bankruptcy Code require an important analysis called "means testing" to determine which chapters you are eligible for, based on your income and allowed expenses. I will carefully review your financial situation to determine what relief is available for you. Filing for bankruptcy provides an "automatic stay" which stops all collection efforts including judgments, garnishments, repossessions and even foreclosures, until the stay is lifted. It can be one of the most important protections bankruptcy can offer you.
